Terms and Conditions

These Terms and Conditions ("Terms") govern access to and use of the website located at www.liftgood.co (the "Site"), the Lift Good mobile and digital platforms, and all wellness programs, services, content, and products offered by Lift Good Inc. ("Lift Good", "we", "us", or "our").

These Terms are specifically aligned with Lift Good’s actual service workflows, including:

  • Corporate wellness programs

  • Health, nutrition, fitness, and lifestyle coaching

  • Educational digital content and mobile app access

  • Employee wellness initiatives

  • Community-based wellness programs

They are localized for users in Guyana and the United States and incorporate HIPAA-aligned provisions where applicable.

By accessing or using the Site or Services, you agree to be legally bound by these Terms. If you do not agree, you must discontinue use immediately.

1. Eligibility and User Acceptance

You must be at least 18 years old to independently use Lift Good Services. Participation by minors is permitted only through schools, organizations, or corporate programs with appropriate authorization and supervision.

By using the Services, you represent that:

  • You have the legal capacity to enter into this agreement

  • Information you provide is accurate and current

  • You will comply with all applicable laws in Guyana, the United States, and any other relevant jurisdiction

2. Description of Services and Workflow Alignment

Lift Good delivers preventive and supportive wellness services, not emergency or acute medical care. Services may include:

​

a. Corporate & Organizational Wellness

  • Employer-sponsored wellness programs

  • Educational workshops and seminars

  • Digital wellness resources for employees

​

b. Individual & Group Coaching

  • Nutrition coaching and meal planning

  • Fitness and lifestyle coaching

  • Habit and behavior change support

​

c. Digital Platforms & Content

  • Access to the Lift Good mobile app and video channels

  • Educational content related to health, nutrition, fitness, and wellness

  • Community engagement tools

Services may be delivered in person, virtually, or through digital platforms. Specific services are defined by program descriptions, proposals, or service agreements.

3. No Medical Care or Emergency Services

Lift Good does not provide emergency medical services, urgent care, or hospital-based treatment.

Unless explicitly stated in a written agreement:

  • Services are not a substitute for professional medical diagnosis or treatment

  • Coaches and facilitators may not be licensed medical practitioners

If you believe you are experiencing a medical emergency, you should contact local emergency services immediately:

  • Guyana: 912 or nearest medical facility

  • United States: 911

4. Health Information, HIPAA, and Data Handling

a. Health and Wellness Information

To deliver personalized wellness services, Lift Good may collect:

  • Health and lifestyle information

  • Nutrition, fitness, and wellness goals

  • Program participation data

This information is used solely to support wellness outcomes and improve service delivery.

b. HIPAA Applicability (U.S.)

Where Lift Good:

  • Acts as a Business Associate to a U.S. HIPAA Covered Entity, or

  • Receives Protected Health Information (PHI) on behalf of such entity

Lift Good will:

  • Comply with HIPAA Privacy and Security Rules

  • Maintain appropriate administrative, technical, and physical safeguards

  • Use PHI only as permitted by law or contract

HIPAA obligations apply only where legally required and do not extend to general wellness data outside HIPAA’s scope.

c. Guyana Data Protection Context

For users in Guyana, Lift Good processes personal data in accordance with:

  • Applicable common law privacy principles

  • Contractual confidentiality obligations

  • Industry best practices for data security

5. User Responsibilities and Informed Participation

You acknowledge that:

  • Wellness results vary by individual

  • Participation is voluntary

  • You are responsible for consulting a qualified healthcare provider before making significant health changes

You agree to provide truthful information and promptly update changes relevant to your wellness participation.

6. Accounts, Access, and Security

Some Services require account creation.

You are responsible for:

  • Maintaining confidentiality of login credentials

  • All activities conducted through your account

Lift Good reserves the right to suspend or terminate accounts for misuse, security risks, or policy violations.

7. Payments, Fees, and Subscriptions

Certain Services require payment or are provided through employer or organizational sponsorship.

Unless otherwise stated:

  • Fees are disclosed before enrollment

  • Subscriptions may renew automatically

  • Payments are processed by secure third-party providers

Refunds: Fees are non-refundable unless expressly stated in a written service agreement.

8. Intellectual Property

All content, materials, programs, branding, and digital assets are owned by Lift Good or its licensors.

You may not:

  • Copy or redistribute content

  • Record or reproduce coaching sessions

  • Use materials for commercial purposes without written consent

9. Acceptable Use

You agree not to:

  • Misuse wellness content or misrepresent services

  • Harass, abuse, or harm others

  • Attempt unauthorized access to systems or data

Violations may result in immediate termination of access.

10. Third-Party Tools and Platforms

Lift Good may use third-party tools for:

  • Payments

  • Video hosting

  • Messaging and scheduling

Lift Good is not responsible for third-party terms, availability, or data practices.

11. Termination of Services

Lift Good may suspend or terminate access:

  • For violations of these Terms

  • To comply with legal or regulatory requirements

  • To protect users or organizational partners

Termination does not waive outstanding payment obligations.

12. Limitation of Liability

To the fullest extent permitted by law in Guyana and the United States:

Lift Good shall not be liable for indirect, incidental, or consequential damages arising from:

  • Participation in wellness activities

  • Reliance on educational content

  • Service interruptions or data loss

Liability, if any, is limited to fees paid within the prior twelve (12) months.

13. Indemnification

You agree to indemnify and hold harmless Lift Good from claims arising from:

  • Your misuse of Services

  • Violation of these Terms

  • Violation of applicable laws

14. Governing Law and Jurisdiction

  • Guyana-based users: These Terms are governed by the laws of the Co-operative Republic of Guyana.

  • U.S.-based users: These Terms are governed by applicable U.S. federal law and the laws of the state determined by Lift Good’s contracting entity.

Courts of competent jurisdiction shall have exclusive authority.

15. Changes to Terms

Lift Good may update these Terms at any time. Continued use of Services after updates constitutes acceptance.
